TERMS AND CONDITIONS

These Terms and Conditions govern your use of the websites and platforms operated by Devatop Centre for Africa Development, available at www.devatop.org, and any related services provided by Devatop Centre for Africa Development.

When you access our websites or use any of our digital platforms, you agree to abide by these Terms and Conditions and to comply with all applicable laws and regulations. If you do not agree with these Terms and Conditions, you are prohibited from accessing our websites or using any other services provided by Devatop Centre for Africa Development.

We, Devatop Centre for Africa Development, reserve the right to review and amend any of these Terms and Conditions at our sole discretion. Upon doing so, we will update this page and notify you through the platforms and/or the email address you provided. Any changes to these Terms and Conditions will take effect immediately from the date of publication.

  1. Use by Minors  

Our platforms are designed to support the reporting and management of human rights abuses, which may involve individuals under the age of 18 as reporters, victims, or subjects of a report.

  1. Where a minor submits a report or interacts directly with our platforms, we process the resulting information solely for child protection, case management, and legal compliance purposes, and in the best interests of the minor concerned.

  2. Parents, guardians, or authorized representatives may submit reports on behalf of a minor.

  3. General platform features not related to case reporting (e.g., account registration for non-case-related services) are intended for users aged 18 and above, unless otherwise stated. Where we become aware that a minor has provided personal data outside the case-reporting context without appropriate authorization, we will take reasonable steps to review and, where appropriate, remove that data.

 

2. Limitations of Use

By using our websites and platforms, you warrant on behalf of yourself, any entity you represent who has entered into these Terms and Conditions, and your users that you will not:

  1. Modify, copy, prepare derivative works of, decompile, or reverse engineer any materials and software contained on our platforms or websites;

  2. Remove any copyright or other proprietary notations from any materials and software contained within our platforms or websites;

  3. Transfer our platform materials to another person or ‘mirror’ the materials on any other server;

  4. Knowingly or negligently use our platforms or any associated services in a way that abuses or disrupts our networks or any other service Devatop Centre for Africa Development provides;

  5. Use our associated services to transmit or publish any harassing, indecent, obscene, fraudulent, or unlawful material;

  6. Use our platforms or associated services in violation of any applicable laws or regulations;

  7. Send unauthorized advertising or spam through our services;

  8. Harvest, collect, or gather user data without the user’s consent; or

  9. Use our platforms or associated services in such a way that may infringe the privacy, intellectual property rights, or other rights of third parties.

  10. Submit report or case information that you know to be false, fabricated, or materially misleading. 

 

3. Intellectual Property

The intellectual property in the materials contained on our platforms and website is owned by or licensed to Devatop Centre for Africa Development. We grant you a limited, non-transferable license to view, use, and display the materials for your personal, non-commercial use only. This constitutes the grant of a license, not a transfer of title. This license shall automatically terminate if you violate any of these restrictions or these Terms and Conditions, and may be terminated by Devatop Centre for Africa Development at any time.

 

4. User-Generated Content

You retain your intellectual property ownership rights over content that you submit to us for publication within our platforms and/or on our corresponding website. We will never claim ownership of your content, but we do require a license from you to use it.

When you use our services to post, upload, share, or otherwise transmit content covered by intellectual property rights, you grant to us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to use, distribute, modify, run, copy, publicly display, translate, or otherwise create derivative works of your content in a manner that is consistent with your privacy preferences and our Privacy Policy.

The license you grant us can be terminated at any time by deleting your content or account. You permit us to use your username and other identifying information associated with your account in a manner that is consistent with your privacy preferences and our Privacy Policy.

 

5. Automatic Updates

You give us permission to download and install operational updates to our digital platforms on your device in accordance with your privacy preferences. This permission can be revoked at any time by modifying your device settings or removing the application platforms.

 

6. Liability

Devatop Centre for Africa Development platforms and the materials within them are provided on an ‘as is’ basis. To the extent permitted by law, Devatop Centre for Africa Development makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property, or other violation of rights.

In no event shall Devatop Centre for Africa Development or its suppliers be liable for any consequential loss suffered or incurred by you or any third party arising from the use or inability to use our platforms, our websites, or any other services provided by Devatop Centre for Africa Development, even if we or an authorized representative have been notified, orally or in writing, of the possibility of such damage.

In the context of this agreement, ‘consequential loss’ includes any consequential loss, indirect loss, real or anticipated loss of profit, loss of benefit, loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings, loss of reputation, loss of use, and/or loss or corruption of data, whether under statute, contract, equity, tort (including negligence), indemnity, or otherwise.

Because some jurisdictions do not allow limitations on implied warranties or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

 

7. Accuracy of Materials

The materials appearing on our platforms or website are not comprehensive and are for general information purposes only. To the extent permitted by law, Devatop Centre for Africa Development does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on our platforms, or otherwise relating to such materials or on any resources linked to our platforms and website.

 

8. Links

Devatop Centre for Africa Development has not reviewed all of the sites linked to its platforms or corresponding website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement, approval, or control by Devatop Centre for Africa Development of the site. Use of any such linked website is at your own risk, and we strongly advise you to make your own investigations with respect to the suitability of those sites.

 

9. Right to Terminate

We may suspend or terminate your right to use our platforms, accounts, and these Terms and Conditions immediately upon written notice to you for any breach of these Terms and Conditions.

 

10. Severance

Any term of these Terms and Conditions which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity of the remainder of these Terms and Conditions is not affected.

 

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Nigeria, the jurisdiction where Devatop Centre for Africa Development is registered, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.
